Will my Health Insurance continue during Maternity Leave?

If you’re planning to take parental leave, you might be wondering: Will my employer continue paying for my health insurance?

The answer is YES!

If your employer normally pays for your health insurance, they must continue covering their share of the cost while you’re on protected leave.

What the Law Says

California law (CFRA and PDL) requires employers to maintain their contributions to your group health benefits while you’re on leave. (Cal. Code Regs., tit. 2, § 11092)

Federal law (FMLA) also mandates that employers must continue paying their portion of your health coverage (29 U.S.C. § 2614(c); 29 C.F.R. § 825.209)

This means your health insurance won’t disappear while you’re out caring for a new baby and recovering from childbirth—as long as your leave is legally protected.

What About My Portion of the Premium?

Even though your employer must continue their contributions, you may still need to pay your share of the premium (the amount normally deducted from your paycheck). Be sure to check with HR about how they’ll collect your portion while you’re on leave—some companies allow payroll deductions, while others might require direct payments.

What If I Don’t Return to Work?

If you don’t return after your leave, your employer may have the right to recover the cost of the premiums they paid on your behalf. However, exceptions apply if you couldn’t return due to circumstances beyond your control (like a serious medical condition).

What Should You Do?

Confirm with HR how your benefits will be handled during leave.
Ask about payment options for your portion of the premium.
Know your rights—your employer cannot drop your coverage while you’re on protected leave!
