What Job Protection Includes

Under CFRA and PDL, an employer must restore the employee to the same or a comparable position after leave. This means:

  • Same salary, benefits, and working conditions
  • Same or equivalent job title
  • No reduction in hours or responsibilities

Employers cannot retaliate against employees for taking parental leave and must ensure a smooth reintegration into the workplace.
